34 Busby Street Planning Proposal update

Council considered the planning proposal for 34 Busby Street at the Ordinary Council meeting on Wednesday 18 March 2026. 

At the meeting Council voted to adopted Option E for the site. 

Following the meeting, a recission motion was lodged on Thursday to have the matter reconsidered by Council.  That recission motion has since been withdrawn today, Friday 20 March 2026. 

As a result of the withdrawal of the rescission motion, the resolution from Wednesday’s meeting stands. The resolution as adopted is included below. 

At the meeting Council adopted Option E 

That Council:  

 a. not proceed with the Planning Proposal in relation to proposed lot 226 34 Busby Street, South Bathurst as exhibited;  

b. adopt instead a Planning Proposal in relation to 34 Busby Street, South Bathurst which amends the Bathurst Regional Local Environmental Plan 2014 to include proposed lot 226, 34 Busby Street, South Bathurst as land subject to the provisions of clause 7.6 Mount Panorama Environs under the Bathurst Regional Local Environmental Plan 2014;  

c. forward the revised Planning Proposal for 34 Busby St, as described in (b) above, to the NSW Department of Planning, Housing and Infrastructure to seek advice as to the need for further community consultation in accordance with section 3.35 of the Environmental Planning and Assessment Act 1979, and if additional consultation is not required, for gazettal;  

d. note that if the Department of Planning, Housing and Infrastructure directs further community consultation, that a further report will be submitted to Council to further consider this matter following the additional exhibition period;  

e. commence preparation of an amendment to the Bathurst Regional Development Control Plan 2014 to include proposed lot 226, 34 Busby Street, South Bathurst within Residential Precinct 1 – Medium Density on the map at schedule 6 and to develop site specific provisions to ensure alignment between the Local Environmental Plan and the applicable Development Control Plan density framework;  

f. notify those who lodged a submission of Council’s decision; and  

g. call a division
