Bathurst Regional Council Public Wireless Access Service: Terms and Conditions of Use

  • These conditions apply to the Public Wireless Access Service used on Bathurst Regional Council Premises.

  • Bathurst Regional Council does not provide technical assistance to configure your equipment for wireless access.

  • Bathurst Regional Council cannot be responsible for any changes you make to your device's settings and recommends you make a note of any settings before you change them.

  • The Public Wireless Access Service may be interrupted from time to time due to system maintenance and Bathurst Regional Council cannot guarantee that access will be continuous and fault free.

  • The Public Wireless Access Service is currently free of charge however Bathurst Regional Council reserves the right to charge for this service in the future.

  • Bathurst Regional Council cannot guarantee the security of the Public Wireless Access Service. Its use, for any purpose, is undertaken at the user’s sole risk.

  • Anti-virus, security and privacy protection is the responsibility of the user.

  • Users must not interfere with the Public Wireless Access Service or disrupt any other user of the service.

  • While accessing the Public Wireless Access Service users who are under the age of 18 must be supervised by a parent or guardian.

  • Bathurst Regional Council is entitled to monitor any activity on its Public Wireless Access Service which will be done in accordance with the Privacy and Personal Information Protection Act 1998 (NSW)

  • Bathurst Regional Council reserves the right to block access to certain websites and materials.

  • To the extent permitted by law, Bathurst Regional Council is not under any liability in respect to any loss or damage to any person or property whether direct, indirect or consequential that may be incurred from the use of the Public Wireless Access Service.

  • Under no circumstances shall Bathurst Regional Council staff members be liable for any direct, indirect, incidental, exemplary or consequential damages (including, but not limited to, loss of data, use, profits, interruption, or safety of equipment) however caused and on any theory of liability (including negligence or otherwise) arising in any way out of the use of the Public Wireless Access Service, even if advised of the possibility of such damage.

  • Any infringement of these terms and conditions may lead to denial of access to the Public Wireless Access Service, being escorted from the premises, and/or referral to an appropriate legal authority.
