Development Contribution Plans
Development Contribution Plans enable Council to require new developments to make a monetary contribution towards the provision or upgrading of services or facilities where that development places a greater demand on those services or facilities. The fees shown in the plans are not the fees payable for the current financial year. Please refer to Council's Revenue Policy for current fees applicable under each plan.
Section 7.11 Development Contribution Plan - Bathurst CBD Car Parking
Land to which the Plan applies
This development contribution applies to certain land within the Bathurst CBD area. See attached map.
Purpose
Contributions paid to Council will fund future car parking facilities within the Bathurst CBD.
Application
Council may accept this development contribution only when onsite car parking facilities, required by Council's Development Control Plan for development within the identified catchment, cannot be accommodated on the development site and Council is satisfied that provision of off-site car parking would be appropriate. The contribution is in lieu of the deficit car parks.
Section 7.11 Development Contribution Plan - Bathurst Regional Community Facilities
Land to which the Plan applies
This development contribution applies to all land within the Bathurst Regional Local Government Area (LGA).
Purpose
Contributions paid to Council will fund community services and community buildings within the Bathurst Region.
Application
The Development Contribution Plan will generally only apply if you are subdividing land, or building more than one dwelling on an existing lot. In these cases, conditions of consent will be imposed requiring a payment in accordance with the adopted contributions Plan. There are also a number of specific circumstances where contributions under this Plan will be required. These include:
- residential, rural and village subdivisions (ie the creation of additional dwelling entitlements); and
- secondary dwellings (granny flat), second rural dwelling, dual occupancies, residential units, shop top housing or rural workers dwellings on all land; and
- residential development on land classified as an "existing holding"; and
- residential development on rural land where a dwelling is permissible because the allotment was created under a previous LEP; and
- residential development on land identified within Schedule 1 – Additional uses of land pursuant to the Bathurst Regional LEP 2014; and
- residential development on land zoned RU5 Village or E4 Environmental Living pursuant to the Bathurst Regional LEP 2014.
NOTE: Alterations and additions to existing dwellings do not attract development contributions.
Section 7.11 Development Contributions Plan - Eglinton Open Space and Drainage
Land to which the Plan applies
This development contribution applies to certain land within the village of Eglinton.
Purpose
Contributions paid to Council will fund future purchase, extension or embellishment of open space land in Eglinton and drainage works that will be required as a consequence of development in the area.
Application
This development contribution is applicable to the following types of developments:
- Residential Subdivision;
- Granny flats;
- Dual occupancies;
- Residential units; and
- Other developments which have the potential to generate additional traffic.
Section 7.11 Development Contributions Plan - Hereford Street
Land to which the Plan applies
This development contribution applies to certain land within the Kelso area.
Purpose
Contributions paid to Council will fund the reconstruction of Hereford Street and the low level bridge over the Macquarie River.
Application
This development contribution is applicable to the following types of developments which lead to increased usage of Hereford Street and the low level bridge:
- Residential Subdivision;
- Granny flats;
- Residential units;
- Dual occupancies; and
- Other developments which have the potential to generate additional traffic.
Section 7.11 Development Contributions Plan - Bathurst Regional Rural Roadworks
Land to which the Plan applies
The Plan applies to land zoned RU1 Primary Production, RU4 Primary Production Small Lots, RU5 Village, E4 Environmental Living and R5 Large Lot Residential (at Mount Rankin, The Lagoon, Trunkey Creek and Wattle Flat) within the Bathurst Regional Local Government Area (LGA).
Purpose
Contributions paid to Council will fund rural road network infrastructure improvements.
Application
This development contribution will generally only apply if you are subdividing land, or building more than one dwelling on an existing lot. In these cases, conditions of consent will be imposed requiring a payment in accordance with the adopted contributions Plan. There are also a number of specific circumstances where contributions under this Plan will be required. These include:
- residential, rural and village subdivisions (ie the creation of additional dwelling entitlements); and
- secondary dwellings (granny flat), second rural dwelling, dual occupancies, residential units, shop top housing or rural workers dwellings on all land; and
- residential development on land classified as an "existing holding"; and
- residential development on rural land where a dwelling is permissible because the allotment was created under a previous LEP; and
- residential development on land identified within Schedule 1 – Additional uses of land pursuant to the Bathurst Regional LEP 2014; and
- residential development on land zoned RU5 Village or E4 Environmental Living pursuant to the Bathurst Regional LEP 2014.

Section 7.11 Development Contributions Plan - Robin Hill Road and Drainage Construction
Land to which the Plan applies
This development contribution applies to certain land within the Robin Hill area.
Purpose
Contributions paid to Council will fund stormwater drainage works and road infrastructure improvements within the development area.
Application
This development contribution is applicable to rural residential development and subdivisions as they will lead to increased stormwater runoff and increased usage of roads.
Section 7.11 Development Contributions Plan - Roadworks – New Residential Subdivisions
Land to which the Plan applies
This development contribution applies to certain land within the Eglinton, Kelso, Llanarth, Windradyne and West Bathurst areas. See attached maps.
Purpose
Contributions paid to Council will fund road infrastructure improvements within the vicinity of the development area and identified within the schedule of works within the Plan.
Application
This development contribution is applicable to the following types of developments as they will lead to increased usage of roads:
- Residential Subdivision;
- Granny flats;
- Residential units;
- Dual Occupancies; and
- Other developments which have the potential to generate additional traffic.
Section 7.11 Development Contributions Plan - Stormwater Drainage Management (Currently under review)
Land to which the Plan applies
Sawpit Creek (East) Stormwater Drainage Management – This development contribution applies to certain land within the Windradyne, Llanarth and Robin Hill areas.
Jordan Creek Stormwater Drainage Managment – This development contribution applies to certain land within the Bathurst, West Bathurst and Robin Hill areas.
Raglan Creek Stormwater Drainage Management– This development contribution applies to certain land within the Kelso and Raglan areas.
Purpose
Contributions paid to Council will fund stormwater drainage infrastructure improvements within the relevant catchment area.
Application
These development contributions are applicable to the following types of developments as they will lead to increased stormwater runoff:
- Residential or Rural Residential Subdivision;
- Granny flats;
- Dual occupancies;
- Residential units;
- Commercial or Industrial Subdivision; and
- Commercial or Industrial development where the impervious area is increased.
Section 7.11 Development Contributions Plan - Bathurst Regional Traffic Generating Development
Land to which the Plan applies
This development contribution applies to certain land within the zones RU1 Primary Production, RU4 Primary Production Small Lots, RU5 Village, R5 Large Lot Residential or E4 Environmental Living within the Bathurst Regional LGA which relies either partially or wholly on the local road network to support your enterprise. The Plan will generally only apply if you are undertaking any traffic generating development.
Purpose
Contributions paid to Council will fund the costs of maintaining local roads resulting from damage caused by heavy vehicles associated with Traffic Generating Developments within the Bathurst Regional LGA.
Application
This development contribution is applicable to developments which have the potential to generate additional traffic. Traffic generating development types are listed within the contributions Plan.
Section 7.11 Development Contributions Plan - Bathurst Regional Open Space
Land to which the Plan applies
This development contribution applies to certain land within the Bathurst Regional LGA. See attached maps.
Purpose
Contributions paid to Council will fund the provision or extension of open space that will be required as a consequence of development in the area or that has been provided in anticipation of or to facilitate such development.
Application
This development contribution is applicable to the following types of development:
- Residential Subdivision;
- Granny flats;
- Residential units;
- Dual Occupancies; and
- Gateway Enterprise Park (See Map No 8 Gateway Enterprise Park (Bathurst Regional DCP 2014).
