Under Section 149 of the Environmental Planning and Assessment Act 1979 a person may, on payment of the prescribed fee, apply to Council for a planning certificate with respect of any land within the area of the Council. Schedule 4 of the Environmental Planning and Assessment Regulation 2000 outlines what the Section 149 Certificate is to contain. The Act and Regulations can be viewed at www.legislation.nsw.gov.au. Section 149 (2) Planning Certificates include information as prescribed by the Regulations. Section 149 (5) Planning Certificates include advice on such other relevant matters affecting the land of which Council may be aware.

The fees (applicable from 1 July 2006 to 30 June 2007) for the planning certificates are:
