Building Certificates (Section 149A) |

Under Section 149(A) of the Environmental Planning and Assessment Act 1979 a person may, on payment of the prescribed fee, apply to Council for a building certificate with respect of any land within the area of the Council. The certificate is to be issued in accordance with section 149A-149E. Part 17 Clause 281 of the Environmental Planning and Assessment Regulation 2000 outlines the form of a S149(A) Certificate. The fees (as of 1 July 2011) for building certificates are:

| Class 1 building (together with any Class 10 building on the site) or a Class 10 building. Fee for each dwelling contained in the building or in any other building on the allotment. |

In the case of any other class of building then as follows:
- Floor area of building or part NOT exceeding 200m2.
- Exceeding 200m2 BUT NOT exceeding 2,000m2. Plus an additional $0.50 per square metre for each square metre over 2,000.
- Exceeding 2,000m2. Plus an additional $0.75 per square metre for each square metre over 2,000.

| In any case, where the application relates to a part of a building and that part consists of an external wall only or does not otherwise have a flood area. |

| If reasonably necessary to carry out more than one inspection of the building before issuing a Building Certificate, Council may require payment of an additional fee. |
